Terms And Conditions
DEFINITIONS
- The following definitions apply to these Terms and Conditions unless otherwise explicitly stated:
- AMCC means Auto Mystique Car Care LLC and its employees.
- Customer means the legal owner of the Vehicle or authorised representative of the legal owner of the Vehicle, entrusting the Vehicle with AMCC throughout the period of the works.
- Expected Delivery Date & Time means the date and time indicated by AMCC to the Customer during the Vehicle Drop Off for completion of the Works on the Vehicle.
- Vehicle means the vehicle listed on the Vehicle Inspection form.
- Works means the repair, treatment or other work to be carried out on the Vehicle, as agreed between AMCC and the customer.
CUSTOMER, VEHICLE DROP OFF AND INSPECTION
2. The Customer represents and warrants that he is the legal owner of the Vehicle or authorised representative of the legal owner of the Vehicle and is entrusting the Vehicle with AMCC, throughout the period of the Works, on his own behalf or on behalf of the legal owner of the Vehicle with full knowledge and concurrence of the legal owner.
3. The Customer represents and warrants that all charges to be levied by AMCC for the Works will be fully binding on the Customer. AMCC reserves the right to take debit or credit card details to secure a booking. Debit or credit cards shall only be charged after the Customer has been notified.
4. AMCC reserves the right at its sole discretion to cancel, defer, alter or move a booking in line with its own needs and requirements for reasons which include (but are not limited to) AMCC’s staffing levels and/or weather conditions and/or machinery or equipment shutdown and/or any other incident that may directly or indirectly impact the Works on the Vehicle. Every effort shall be made to communicate any changes prior to arrival. AMCC also reserves the right to assign any of its staff to carry out the Works on the Vehicle.
5. The Customer should remove all personal belongings, money and other valuable items from the Vehicle during drop off. AMCC will not accept any liability for any loss or damage to any personal property during the works.
6. At the time of dropping off the Vehicle, AMCC will carry out an inspection of the Vehicle which will be recorded on the Vehicle Inspection Form.
7. In the event that any dents, scratches or other defects of the Vehicle are discovered by AMCC following drop off and completion of the Vehicle Inspection Form, AMCC reserves the right to alter the Vehicle Inspection Form. AMCC may take pictures and/or photographs prior to any Works being carried out on the Vehicle or following discovery of the dents, scratches or other defects of the Vehicle as evidence of such defects. Pictures and/or photographs taken of the Vehicle during Inspection, or subsequently, are the sole property and ownership of AMCC and can be used in any subsequent proceedings, as required. Pictures and/or photographs taken of the Vehicle during Inspection, or subsequently, shall take precedence over any contrary information contained within the Vehicle Inspection Form.
8. AMCC shall not be responsible for any faults on or with the Vehicle at the time of drop off. Failure, by the Customer, to report any pre-existing faults on or with the Vehicle at the time of drop off excludes AMCC from any responsibility for any faults subsequently discovered with the Vehicle, whether pre-existing or otherwise.
WORKS
9. The Customer authorises AMCC to carry out the Works, in a manner and using the materials decided by AMCC at its sole discretion. AMCC reserves the right to outsource certain Works and/or use third party vendors to provide certain services, including, but not limited to Recovery Services, Painting, Rim Refurbishment, etc.
10. During the Works, whilst AMCC shall take every precaution necessary to ensure the safety of the Vehicle, personnel and surroundings at all times, AMCC shall not be held responsible for any loss, damage and/or consequential loss caused to the Vehicle, its parts and/or its accessories.
11. During the Works, the Vehicle may require to be moved / driven within AMCC’s facility. Whilst AMCC shall take every precaution necessary to ensure the safety of the Vehicle at all times, AMCC shall not be held responsible for any loss, damage and/or consequential loss caused to the Vehicle, its parts and/or its accessories.
12. ‘Gtechniq’ coatings are subject to a separate Warranty document and Terms and Conditions, which AMCC shall provide to the Customer. The ‘Gtechniq’ Warranty document and Terms and Conditions are in no way related to, or interchangeable with, these Terms and Conditions.
PRICE, PAYMENT AND DELIVERY
13. AMCC’s prices are based on treatment type, type of vehicle and the condition of the Vehicle. Prices will be advertised as a FROM price and are indicative only. AMCC reserves the right to alter its advertised pricing without any prior notice to the Whilst AMCC endeavors to keep all information on its website accurate and current, content on the website is provided for informational purposes only. The Customer is responsible for any consequences resulting from reliance of the website.
14. AMCC reserves the right to amend any price during the Works should the cost of materials, labour or other costs directly or indirectly associated with the Works differ from the original estimate.
15. AMCC reserves the right to charge a minimum 20% surcharge to any Works that may involve excessive pet hair, urine, vomit, blood, faeces, dirt or other hazardous materials.
16. All payments for the Works are to be paid to AMCC on, or before, the delivery of the AMCC reserves the right in its sole discretion to refuse to deliver the Vehicle to the Customer, or anyone else, unless all payments due for the Works are paid to AMCC.
17. The Expected Delivery Date & Time are purely indicative in nature and may vary depending on the nature of the Works or other AMCC will not be responsible or liable for any change in the Expected Delivery Date & Time.
18. The Customer agrees to collect the Vehicle within two days of being informed by AMCC of the completion of the Works, failing which the Customer is liable to pay AMCC AED 200 per day towards storage charges for the Vehicle. AMCC assumes no responsibility or liability for the Vehicle, including but not limited to the safety of, upkeep of, damage to or deterioration of the Vehicle, its parts and/or its accessories if it is not collected by the customer within two days of being informed by AMCC of the completion of the Works.
19. The Vehicle will only be delivered to the legal owner of the Vehicle or to an authorised representative of the legal owner of the Vehicle, provided the legal owner of the Vehicle has informed AMCC in writing that the Vehicle is to be collected by the authorised representative of the legal owner of the Vehicle.
20. On receipt of the Vehicle from AMCC the Customer is required to conduct an inspection of the Vehicle and notify AMCC of any issues immediately. Should the Customer take delivery of the Vehicle without raising any issues with AMCC, the Customer accepts the Works and waives any subsequent claims it may have against AMCC related to the Works.
MISCELLANEOUS
21. AMCC has the right to take pictures and/or photographs of the Vehicle at any time prior to, during, or following completion of the Works. AMCC has the exclusive rights and ownership of all such pictures and/or photographs and can use them at its sole discretion, including for the purposes of marketing its services. AMCC may use such pictures and/or photographs to post on their own website and/or any other social media platforms (including but without limitation Google +, Instagram, Twitter, Facebook, Whatsapp etc.). All pictures and/or photographs are the sole intellectual property of AMCC.
22. All content, including copy, logos and imagery directly or indirectly associated with AMCC are the sole intellectual property of AMCC and must not be used without the express written permission of AMCC.
23. All emails sent by AMCC to the Customer at the Email address listed on the Vehicle Inspection Form are deemed to have been immediately delivered to the Customer for the purposes of all communications, notices or legal service required to be sent to the Customer.
24. These Terms and Conditions shall be governed and interpreted in accordance with the laws, decrees and regulations of the Emirate of Dubai, United Arab Emirates. Any dispute, claim, question or difference arising out of or in connection with these Terms and Conditions, and whether as to construction, interpretation or otherwise arising out of these Terms and Conditions, if not amicably resolved between the Customer and AMCC, shall be finally settled by the courts of the Emirate of Dubai.
25. AMCC reserves the right to change and/or update these Terms and Conditions without any prior notice to the These Terms and Conditions shall be available to review on AMCC’s official website: www.amcc.ae .
REFUND
26. Due to the nature of the business, AMCC does not offer any refunds once the works are done and Vehicle is accepted by the Customer.
